Any person wishing to appeal a decision of the council or file a grievance must first request in writing to the council chairperson an opportunity to be heard. The request shall include information about the grievance issue. All appeals/grievances must focus directly on policy decisions made by the council.
The council shall schedule a hearing within thirty (30) days from the date the request is received. The person appealing shall be informed of the hearing by registered letter.
The person appealing may be represented by legal counsel and may call witnesses as long as the testimony is germane to the issue. The Chairperson must be notified ten (10) days in advance if the person appealing will have an attorney present. The council may also be represented by legal counsel and call witnesses.
The council shall consider the merits of the complaint, make a decision, and respond in writing to the complaint within sixty (60) days of the completion of the hearing. The chairperson shall develop and disseminate the response, with the approval of the council.
A copy of the written grievance or appeal and the response of the council shall be provided to the superintendent.
